Procedural Justice
- Accept bad legal outcomes if good legal procedures took place.
- Example:
- If everything was very fair, then a punishment makes sense.
- One person cuts a candy bar, another chooses which side.
- Consent to the procedure beforehand.
- Fair procedure.
- They satisfy a lot a the criteria of Legitimacy.
- If the procedure was:
- Trustworthy
- Respectful
- Neutralize
- Voice was heard
- Procedural Injustice
- Not the above.
- You question the Legitimacy of the law.
- Fairness is better than favourability.
- Similar punishments for everyone.
- Not favourability. There can always be a situation where people are getting away with shit.
- Procedure is better than the outcomes.
- Habits matter more than choices.
- Rational choice theory
- Example: Putting on our seatbelts
- It's a habit rather than a choice most times.
- Legitimacy matters more than force
- Legitimacy would be the root cause. If people believe in the law, they'll abide by it more, than through force.
